Terms of Service

Please read these Terms carefully. By accessing or using the Platform, you agree to be bound by them. If you do not agree, you must not access or use the Platform.
Welcome to Epic Africa. These Terms of Service (“Terms”) are a binding agreement between you (“User”, “you”) and Epic Escapes Limited, a company incorporated in Kenya, which operates the Epic Africa platform at www.epic.africa and our related mobile applications and services (together, the “Platform” or “Site”; “we”, “us” or “our”).
1. Agreement to these Terms
By using the Platform you agree to comply with and be bound by these Terms and our Privacy Policy. You also confirm that you are at least 18 years old (or the age of majority in your jurisdiction) and have the legal authority to enter into these Terms.
2. Our role as a facilitator
Epic Africa provides a platform that connects users (“customers”) with independent third-party service providers and hosts across Africa (“Providers”), including travel services, accommodation, tours, dining, events, experiences and other related services (“Services”). We facilitate the discovery, comparison and booking of these Services, but, unless expressly stated otherwise, we do not provide the Services directly.
All agreements for the provision of a Service are between you and the relevant Provider. We do not take responsibility for the fulfilment or quality of Services offered by Providers, and you should carefully review each Provider’s terms, policies and any applicable agreements before booking.
2.1 Availability of Services
The availability of Services listed on the Platform is subject to change without notice, and we make no guarantee that any Service will be available at a given time. Providers may impose additional terms, including age restrictions, booking policies, cancellation policies and specific usage guidelines.
3. Eligibility and user accounts
You are responsible for ensuring that the information you provide to us is accurate, current and complete. You must safeguard your account credentials and are responsible for all activity that occurs under your account.
3.1 Account security
You agree to keep your account credentials confidential and to notify us immediately of any unauthorised use of your account or any other breach of security.
4. Privacy and data protection
Your use of the Platform is subject to our Privacy Policy, which explains how we collect, use and protect your personal data. By using the Platform, you agree that we may process your personal data in accordance with that policy.
5. Bookings and payments
All bookings are subject to availability and confirmation by the relevant Provider. A “Package” means a bundle of components offered for one fixed price; offerings sold individually are shown as “Items”. A booking is confirmed once payment is successfully completed and you receive a confirmation. Issues relating to the fulfilment, cancellation or modification of a booking should, in the first instance, be resolved with the Provider.
5.1 Payment processing
Payments are processed securely by our third-party payment provider, Paystack, and may be charged in supported local currencies (including Kenyan Shillings), depending on your location and the experience. By making a booking, you agree to pay all applicable fees and taxes and to provide valid payment information. Your card details are entered and handled directly by the payment processor; we do not store your full card number.
5.2 Currency and exchange rates
Prices may be displayed in different currencies, and the final amount charged may vary based on exchange rates and any charges applied by your bank or payment provider. Epic Africa is not responsible for currency-conversion differences or fees imposed by financial institutions.
5.3 Cancellations and refunds
Cancellation and refund terms vary by Provider and by Service; please review the applicable policy before booking. Approved refunds are returned to your original payment method. Except where Epic Africa is expressly the provider of a Service, we are not responsible for refund disputes and will not intervene in financial disagreements between Users and Providers.
6. Host and Provider obligations
Providers and hosts listed on the Platform are independent businesses responsible for delivering the Services they advertise. They must describe their Services, availability and pricing accurately, hold the rights, licences and permits required to offer them, comply with applicable laws, complete identity verification (KYC) where required, and honour confirmed bookings. Epic Africa does not warrant the performance, quality or safety of Services provided by Providers, and we encourage Users to review ratings and feedback before booking.
7. User conduct
When using the Platform, you agree to:
- Comply with all applicable laws and regulations;
- Provide accurate and truthful information during the booking process;
- Not impersonate any person or entity, or misrepresent your identity;
- Not post, upload or share content that is offensive, illegal, defamatory or harmful;
- Not interfere with the operation of the Platform, including through hacking, denial-of-service attacks or the introduction of malicious code;
- Not use the Platform for fraud or any unauthorised or unlawful purpose.
8. Reviews and user content
You are responsible for any content you submit, and you grant us a licence to host and display it in connection with the Platform. We may remove content that violates these Terms or applicable law.
9. Intellectual property
All content on the Platform — including text, graphics, images, logos and software (excluding Provider- and user-supplied content) — is the property of Epic Escapes Limited or its licensors and is protected by copyright, trademark and other intellectual-property laws. You may not reproduce, distribute, modify or exploit any such content without our prior written permission.
10. Disclaimer of warranties
The Platform and all Services are offered on an “as is” and “as available” basis. To the extent permitted by law, Epic Africa does not guarantee the accuracy, completeness or reliability of the Platform’s content or Services, and disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.
11. Limitation of liability
To the maximum extent permitted by law, Epic Escapes Limited and its affiliates, officers, employees and agents are not liable for any indirect, incidental, special or consequential damages — including loss of profits, data or business opportunities — arising out of or in connection with your use of the Platform or Services provided by Providers. Our total liability to you under any circumstance will not exceed the amount you paid for the specific Service giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
12. Indemnification
You agree to indemnify and hold harmless Epic Escapes Limited, its affiliates, officers, employees and agents from any claims, damages, liabilities, costs or expenses (including reasonable legal fees) arising from your use of the Platform, your violation of these Terms, or your infringement of any third-party rights.
13. Termination
We reserve the right to suspend or terminate your access to the Platform at our discretion, without notice or liability, for conduct that we believe violates these Terms or applicable law, or is harmful to our interests or those of other users or Providers.
14. Governing law and dispute resolution
These Terms, and any dispute arising out of or relating to your use of the Platform or the Services, are governed by the laws of Kenya, without regard to conflict-of-law principles. You agree to submit to the exclusive jurisdiction of the courts of Kenya, without prejudice to any mandatory consumer-protection rights you may have.
15. Changes to these Terms
We may modify these Terms at any time. If we make changes, we will update the “Last updated” date above. Your continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
